Terms & Conditions
These Terms and Conditions (“T&Cs”) apply to all bookings made with Maluti Mountain
Adventures & Lesotho Tours (“the Provider”, “we”, “us”) for participation in activities, tours, or
related services. By booking with us, participants (“the Client”, “you”) agree to be bound by
these T&Cs.
1. Bookings & Payment
1.1 A booking is only confirmed once payment (deposit or full) has been received.
1.2 Deposits are non-refundable unless otherwise stated.
1.3 Full payment must be made no later than 72 hours before the activity date or check in.
1.4 Payment in full is required if the booking date is 1 week or less from commencement of
booking.
1.5 We reserve the right to cancel unconfirmed bookings.
2. Cancellations & Refunds
2.1 Cancellation Policy
● No refund of deposit if booking is cancelled 14 days or less from commencement of
tour.
● No refund at all if cancelled 72 hours of less of commencement of booking
2.2 Provider Cancellations:
● We reserve the right to cancel or reschedule due to weather, safety, or operational
reasons.
● Please note: Rain is not considered a valid reason for cancellation. Rain gear and/or
umbrellas will be provided.
3. Participant Requirements
3.1 Minimum age: 5. Minors must be accompanied by a parent/guardian.
3.2 Clients must disclose any medical conditions that could affect participation.
3.3 Weight/height limits may apply 180kg total per quad.
3.4 Alcohol, drugs, or any intoxicants are strictly prohibited before/during activities.
3.5 Access to Solitude Clarens/ Maluti Mountain Adventures - A high-rise vehicle is
recommended during non-rainy months, and a 4x4 is recommended in the rainy season. While
most vehicles are generally able to access the cabin under normal conditions, please note that
the gravel road can become difficult to access in wet weather.
4. Safety & Compliance
4.1 All instructions from guides and staff must be followed at all times.
4.2 We reserve the right to deny participation if you are deemed unfit or unsafe.
4.3 Clients participate at their own risk and must act responsibly.
4.4 Clients will be held fully responsible for the cost of any damage to quads or accommodation
caused as a result of negligence, reckless behavior, or failure to follow safety instructions.
Normal wear and tear is excluded.
5. Risk & Liability
5.1 Participation in activities carries inherent risks (including injury or death).
5.2 By booking, you acknowledge and voluntarily accept these risks.
5.3 To the extent permitted by South African law, we are not liable for loss, injury, damage, or
death arising from participation, except where caused by our gross negligence.
5.4 Clients are advised to obtain personal travel/medical insurance.
6. Changes to Activities
6.1 We reserve the right to alter or substitute activities due to weather, safety, or operational
concerns.
6.2 Where possible, a comparable activity will be offered.
7. Media & Marketing
7.1 We may take photos/videos during activities for promotional purposes.
7.2 By participating, you consent to the use of such media unless you notify us in writing
beforehand.
8. Privacy & Data Protection
8.1 Personal information is collected in compliance with the Protection of Personal
Information Act (POPIA).
8.2 We do not sell or share your data with third parties, except as required to provide service
9. Governing Law
These T&Cs are governed by the laws of the Republic of South Africa. Any disputes shall be
resolved in South African courts.
10. Acceptance
By booking and participating, you confirm that you:
● Have read and understood these T&Cs;
● Are physically fit to participate;
● Accept full responsibility for your actions during the activity.
